Information from Division of Water Resources on Angelview’s Water Augmentation Plan

as it relates to the Twin Lakes Village. 

Followed by the 4/15/24 Decree and a letter from AngelView to Twin Lakes.

Attached is the SWSP Angelview is currently operating pursuant to, for your review.  The State did not “determine that the West Fork was the historic channel”, we stipulated to an administrative plan that is protective of Lake County’s deliveries under their aug plan (98CW173) of fully consumable Derry Ditch No. 3 water to Twin Lakes, and allows Angelview to operate their SWSP(active)/aug plan (2021CW3008-amended, pending) in a way that is protective of senior water rights.
What Mr. Elias is referring to is the fact that if Lake County is making deliveries to Twin Lakes, (up to 2 cfs),  from May to October (See 98CW173 Paragraph 8.5.7), the delivery window where Angelview must leave up to 2 cfs in Bartlett Gulch, can be as short at 37 days in a season. Mr. Elias is citing data from the Mount Massive Golf Course Rule 14 plan, which is currently taking credit for all available Derry Ditch 3 deliveries. The table he referenced shows that in 2023 Mount Massive Golf Course took the max rate available and they volumetrically limited out in 37 total days of delivering CU water over the course of the summer. In the future, when Lake County’s plan is fully operational, Lake County may chose to operate differently, by either extending the time water is being delivered to Twin Lakes, (within the 183 day window from May to October), at a lower rate, or they could chose to use their alternate point at the Golf Course and Angelview would be entitled to sweep the first 6 cfs in Bartlett Gulch all season.  Angelview is limited to a max of 6 cfs. Flows above 6 cfs plus Lake County”s water, if it is there, would need to be directed back to the West Branch.
That is how I understand the plans operate.  I don’t anticipate that minimum flows will be an issue this spring.  When things thaw out and we get past this particularly busy start up to irrigation season, I can again come address the town, but to my knowledge, the town does not have any rights to call water down the West Channel.
